## 1. Access & Account
By agreeing to these Terms, you represent that you are at least 21 years of age and the legal age of majority in your state of residence. You may not use this site if you are under 21.
To purchase products, you may be asked to provide your email address, billing, payment, and shipping information. You warrant that all information you provide is accurate, current and complete. You are responsible for maintaining the security of your account credentials and all activity under your account. You may not transfer, sell, or assign your account to any other person.
## 2. Products & Artisan Variation
All Emberform porcelain pieces are entirely hand-thrown and hand-painted by master artisans in Jingdezhen. Slight variations in glaze, color, shape, and kiln transformation are natural and inherent characteristics of handmade ceramic art. No two pieces are identical.
We have made every effort to display product colors and details accurately. However, appearance may vary slightly from your screen due to device settings. Product images are for reference only; the actual piece you receive may differ slightly from photography.
We reserve the right to discontinue any product or limit quantities at any time, for any reason.
## 3. Orders & Payment
When you place an order, you make an offer to purchase. Emberform reserves the right to accept or decline any order for any reason.
Full payment must be received before production or shipment begins. Prices are listed in US dollars (USD) and do not include state sales taxes unless otherwise stated. Import duties and customs fees are prepaid for all DDP US orders.
### Critical rule for custom & limited pieces
For all custom, personalized, limited-edition and pre-sale items:
- Your order is deemed **confirmed immediately upon successful payment**
- Artisan production commences immediately after confirmation
- **No cancellations will be accepted once payment is confirmed**
Your purchases are subject to return or exchange solely in accordance with our Refund Policy. You warrant that your purchases are for your own personal use and not for commercial resale.
## 4. Shipping & Delivery
All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control.
Risk of loss and title to products pass to you upon handover to the shipping carrier at our fulfillment facility.

## 5. Returns, Cancellations & Refunds
- **In-stock items**: you may submit a return request within 7 days of delivery. Items must be unused, in original packaging, with proof of purchase. Return shipping costs are the customer’s responsibility. Items returned without prior approval will not be accepted.
- **Custom, personalized, limited-run & pre-sale pieces are FINAL SALE**. No cancellations, returns, or refunds will be granted once your order is confirmed, except for verified delivery damage reported in writing within 48 hours of receipt.
Approved refunds will be processed back to your original payment method within 10 business days.

All designs, artwork, photography, text, product concepts and brand assets on this website are the exclusive property of Emberform. They are protected by US and international copyright and trademark laws.
You may use this website and its content for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or resell any of our intellectual property without prior written permission.
Personalized custom pieces are created for your personal use only and may not be resold, reproduced, or commercially exploited.
## 7. Disclaimer of Warranties
Our products and website are provided “as is” and “as available” without any express or implied warranties, including but not limited to merchantability or fitness for a particular purpose. We do not guarantee that the website will be uninterrupted or completely error-free.
Some jurisdictions do not allow the disclaimer of implied warranties, so the above may not apply to you.

To the fullest extent permitted by law, Emberform, Shopify and our partners shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, lost revenue, or loss of data, arising from your use of our services or products.
